Types of Yacht Registration in Malta
The Merchant Shipping Directorate in Malta classifies yachts into two main categories: private and commercial.
Private Yachts are defined as ships 6 metres in length or longer used solely for the owner's pleasure. They cannot carry passengers for reward and cannot be engaged in trade.
Commercial Yachts are generally defined as yachts 15 metres in length or longer which do not carry cargo and carry no more than 12 passengers. These vessels are operated by the owner or a corporate entity for commercial purposes (chartering).
There is no "better" option between the two; it depends entirely on your intended use. It is up to the owner to decide whether the vessel is strictly for recreation or for generating profit. Naturally, commercial yachts face stricter regulations and slightly higher registration and annual fees due to the commercial nature of their operation.
It is also worth noting that your choice isn't set in stone. You can switch from private to commercial registration (and vice versa), provided the yacht meets the necessary technical and safety requirements for the new category.
The Resident Agent
Before starting the registration process, there is a key requirement for international owners. If you are not a resident of Malta, you must appoint a Resident Agent to act on your behalf. This applies to individuals residing in the EU, EEA, or Switzerland who do not live in Malta.
The Resident Agent acts as the local representative for the international shipowner. Their powers and responsibilities include:
- Acting as the communication channel between the international owner and Maltese government departments;
- Signing and filing all forms or documents required by Maltese authorities on the owner's behalf;
- Acting as the judicial representative for the international owner in Malta.
Provisional Registration
The first step in flying the Malta flag is applying for provisional registration. This is valid for six months and can be extended for additional periods, provided the total provisional period does not exceed six months.
To apply, the following criteria must be met:
- All documents required for provisional registration must be submitted to Transport Malta;
- The proposed name of the vessel must be reserved with Transport Malta;
- Proof of ownership must be provided;
- A Resident Agent must be appointed (if applicable);
- A declaration of ownership must be signed before the Registrar;
- An application for a ship radio station licence must be submitted (where necessary);
- Payment of official registration fees and annual tonnage tax must be settled.
During this provisional period, the owner can sail the yacht, provided specific safety criteria are met and the provisional certificate from the Malta registry is kept on board at all times.

Permanent Registration
To secure permanent registration, owners must submit the final documentation to the Merchant Shipping Directorate before the provisional registration expires.
The key documents usually required include:
- The original Builder’s Certificate (if the vessel has not been registered elsewhere previously);
- A survey of the vessel carried out by a ship surveyor appointed by Transport Malta;
- The Carving and Marking Note, duly signed by a government surveyor or a recognised classification society, confirming the vessel has been marked with its name and port of registry;
- A radio inspection (if required), along with any other case-specific documentation.
Once approved, a Certificate of Malta Registry is issued for one year. This is renewable annually upon payment of the relevant fees. Like the initial registration costs, annual fees depend on the yacht's tonnage and type.
Technical Inspections
Part of what makes the Maltese flag respected globally is that it is not a "flag of convenience" with low standards. The authorities take safety seriously to ensure Maltese ships are never substandard. Consequently, regular inspections are carried out.
Registered yachts must undergo specific surveys by an appointed ship surveyor or a recognised organisation. Compliance certificates are issued upon successful inspection and typically remain valid for five years.
For commercial yachts, surveys are more frequent. They must be carried out annually for vessels 24 metres or longer, or as intermediate surveys for vessels under 24 metres.
