The Maastricht Treaty introduced the concept of Union citizenship, which automatically applies to every national of a Member State. It is this Union citizenship that underpins the right of persons to move and reside freely within the territory of the Member States. Articles 79 and 80 of the Treaty on the Functioning of the European Union (TFEU) define the responsibilities in the area of regular immigration as follows: The EU is responsible for establishing the conditions for entry and lawful residence of third-country nationals in a Member State, including for family reunification purposes. Member States retain the right to determine the volume of admission of third-country nationals for job-seeking purposes.
EU/EEA nationals planning to move to Malta for an indefinite period must register with the local authorities no later than three months after arrival. Non-EU/EEA nationals intending to stay in Malta for more than 90 days must apply for a temporary residence permit, which either requires proof of financial independence or an application for a work visa. Citizens staying in Malta for more than three months must register with the Maltese authorities.
